Terms of Service

Welcome to Rise Cremation ("Rise Cremation," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of risecremation.com (the "Site") and the services offered through it (the "Services"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Description of Services
Rise Cremation is a referral and coordination platform that connects families with independently owned and operated, licensed funeral homes and crematories in Utah ("Service Providers") to arrange direct cremation services. Rise Cremation is not a funeral home, mortuary, or crematory, and does not itself perform embalming, cremation, or other funeral services. All cremation services are performed exclusively by the licensed Service Provider assigned to your order.
2. No Pre-Need Arrangements
The Services are available only after a death has occurred. Rise Cremation does not offer pre-need or pre-arrangement funeral planning, and orders cannot be submitted or paid for in advance of a death.
3. Placing an Order
When you submit an order through the Site, you represent that you are the legally authorized next of kin or otherwise have the legal authority to arrange cremation services for the decedent. You are responsible for providing accurate information, including the decedent's identifying information and date of death. A signed cremation authorization form is required by the assigned Service Provider before cremation services are performed, consistent with Utah law.
4. Pricing and Payment
The base direct cremation service is offered at the price displayed on the Site at the time of your order. Additional charges may apply, including certified death certificate fees and remains weight surcharges; these amounts, where known, are disclosed to you before you complete payment. Payment is processed securely through our third-party payment processor, Stripe. Rise Cremation does not store your full payment card information.
5. Cancellations and Refunds
You may request cancellation of an order at any time before cremation services have begun by contacting support@risecremation.com. Refunds for orders cancelled before services begin will be issued minus any non-refundable costs already incurred by Rise Cremation or the assigned Service Provider. Once cremation services have been performed, orders are non-refundable.
6. Shipping of Cremated Remains
Cremated remains are shipped via the United States Postal Service in accordance with applicable federal regulations, with tracking information provided to you. Rise Cremation is not responsible for delays or issues caused by the shipping carrier once remains have been tendered for shipment.
7. Your Account
If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
8. Prohibited Uses
You agree not to misuse the Site, including by submitting false information, attempting to interfere with the Site's operation, or using the Site for any unlawful purpose.
9. Third-Party Service Providers
Rise Cremation is not liable for the acts, omissions, or professional services of any independently licensed Service Provider. Each Service Provider is solely responsible for compliance with applicable licensing, insurance, and professional standards.
10. Limitation of Liability
To the fullest extent permitted by law, Rise Cremation's total liability arising out of or related to your use of the Site or Services shall not exceed the amount you paid to Rise Cremation. Rise Cremation is not liable for indirect, incidental, or consequential damages.
11. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
